NOTICE OF PRIVACY MR.PRESTA, S.A. DE C.V., S.O.F.O.M., E.N.R.<\/strong><\/p>\n

En virtud de lo dispuesto por la Ley Federal de Protecci\u00f3n de Datos Personales en Posesi\u00f3n de Particulares (LFPDPPP), su Reglamento, los Lineamientos del Aviso de Privacidad y las dem\u00e1s Disposiciones aplicables (en adelante denominados conjuntamente como la \u201cLey\u201d), se emite el presente Aviso de Privacidad (en lo sucesivo el \u201cAviso\u201d) en los siguientes t\u00e9rminos y condiciones:<\/p>\n

A. RESPONSIBLE FOR THE PROTECTION OF YOUR PERSONAL DATA.<\/strong><\/p>\n

Presta, S.A. DE C.V., S.O.F.O.M., E.N.R., cuyo nombre comercial es MR Presta (en lo sucesivo la \u201cSociedad\u201d) es responsable del tratamiento de sus datos personales, la cual tiene su domicilio en Torres IOS Campestre, Ave. Ricardo Margain 575, Parque Corporativo Santa Engracia, San Pedro Garza Garc\u00eda, Nuevo Le\u00f3n, M\u00e9xico (en lo sucesivo el \u201cDomicilio de la Sociedad\u201d), su correo electr\u00f3nico es soporte@mrpresta.com<\/a><\/u>(hereinafter the \"Company Mail\") and its telephone number is +52 (81) 8000 7946 (hereinafter the \"Company Telephone\"). In addition, the data of the person in charge (hereinafter the \"Person in Charge\") of the Department of Personal Data of the Company are the following: (i) Carlos Rosso; and (ii) the Person in Charge can be reached at the Company's Domicile, at the Company's Mail and on the Company's Telephone.<\/p>\n

B. DATOS PERSONALES RECABADOS Y SOMETIDOS A TRATAMIENTO.<\/strong><\/p>\n

Conforme a lo anterior, le informamos que MR. PRESTA obtendr\u00e1 sus datos personales, ya sea de forma directa o indirecta, cuando realiza una solicitud y proporciona sus datos personales para efectos de la prestaci\u00f3n de los servicios de cr\u00e9dito que ofrece MR. PRESTA, a trav\u00e9s de nuestra p\u00e1gina de Internet, la (\u201cP\u00e1gina\u201d) y a trav\u00e9s de un tercero (socio comercial) o cualquier otro medio personal o electr\u00f3nico.<\/p>\n

MR. PRESTA sujeta a tratamiento sus siguientes Datos Personales obtenidos a trav\u00e9s de los medios antes descritos:<\/p>\n

a)Datos de identi\u00adcaci\u00f3n y contacto<\/p>\n

b)Datos migratorios<\/p>\n

c)Datos Patrimoniales y\/o financieros<\/p>\n

Adicionalmente se da tratamiento a los siguientes Datos Sensibles:<\/p>\n

Estos datos podr\u00e1n ser utilizados, entre otros fines, para evaluar los riesgos inherentes al cr\u00e9dito que solicite, verificar su identidad, evaluar y calificar su capacidad crediticia y;
se hace de su conocimiento que MR. PRESTA trabaja con socios comerciales, por lo que cualquier dato que usted proporcione a cualquier de estos, s\u00e9ra bajo el propio Aviso de Privacidad de cada uno de nuestos socios comerciales, por lo que MR. PRESTA solo tendr\u00e1 la responsabilidad de protecci\u00f3n de los datos personales sobre los datos propionados directamente, por lo tanto, usted como Titular de los datos, ser\u00e1
el \u00fanico responsable de la informaci\u00f3n y datos personales que comparta y el tratamiento que se les d\u00e9 bajo dichos supuestos.<\/p>\n

C. FINALIDAD CON QUE SE RECABAR\u00c1N Y UTILIZAR\u00c1N SUS DATOS PERSONALES.<\/strong><\/p>\n

b.<\/strong> Verificar el historial crediticio de las personas que soliciten un cr\u00e9dito.<\/p>\n

c.<\/strong> Integraci\u00f3n del expediente de informaci\u00f3n de nuestro cliente.<\/p>\n

d.<\/strong> Gesti\u00f3n, control, administraci\u00f3n y procesamiento de la solicitud de cr\u00e9dito y, en su caso, el otorgamiento de este.<\/p>\n

e.<\/strong> Gesti\u00f3n, control, administraci\u00f3n, ejecuci\u00f3n y cumplimiento del contrato de cr\u00e9dito celebrado con el cliente conforme a la solicitud correspondiente.<\/p>\n

f.<\/strong> Gesti\u00f3n, control y administraci\u00f3n de la cobranza administrativa (a trav\u00e9s de cualquier medio de contacto otorgado en la solicitud), extrajudicial y, en su caso, judicial derivada de los servicios proporcionados por MR. PRESTA.<\/p>\n

g.<\/strong> Investigaci\u00f3n de cambios en el perfil transaccional del cliente.<\/p>\n

h.<\/strong> Cumplimiento a obligaciones de car\u00e1cter fiscal o comercial.<\/p>\n

i.<\/strong> Atenci\u00f3n de consultas, dudas, aclaraciones o quejas del cliente.<\/p>\n

j.<\/strong> Estad\u00edstica y registro hist\u00f3rico de usuarios y clientes.<\/p>\n

k.<\/strong> Creaci\u00f3n, mantenimiento y entrenamiento de los modelos de riesgo predictivos de MR. PRESTA.<\/p>\n

l.<\/strong> Mantener la seguridad de la informaci\u00f3n y de la operaci\u00f3n.<\/p>\n

m.<\/strong> Protecci\u00f3n ante casos de robo de identidad.<\/p>\n

D. DATOS PERSONALES QUE OBTENEMOS DE USTED Y A TRAV\u00c9S DE QUE MEDIO LOS OBTENEMOS.<\/strong><\/p>\n

For the purposes indicated in the Notice, we may collect your personal data in different ways, when (i) you provide them directly to us; (ii) you visit our website or use our online services; (iii) we obtain information through other sources that are permitted by Law; and (iv) we collect and obtain information through the approval and authorization of the Client to third parties who own databases to provide their information or contact details.<\/p>\n

E. USO DE COOKIES, WEB BEACONS Y OTRAS TECNOLOG\u00cdAS.<\/strong><\/p>\n

G. LIMITACI\u00d3N DEL USO DE SUS DATOS PERSONALES.<\/strong><\/p>\n

You can stop receiving information of any nature from the Company through emails or telephone calls by giving a notification to the Manager of the Company's Personal Data Department at the (i) Company address; or (ii) Company Mail; or (iii) Company telephone number.<\/p>\n

The Company in this act expresses its consent and indicates that all information and data about you that are known to the Company will be solely and exclusively for purposes derived from the Contract, for which the Company acknowledges that no data or information of yours will be sold to third parties or parties that are not specifically linked to the relationship that exists between the Company and the Client, except in the event that such information is required by a governmental or regulatory authority.<\/p>\n

H. EJERCICIO DE SUS DERECHOS DE ACCESO, RECTIFICACI\u00d3N, CANCELACI\u00d3N Y OPOSICI\u00d3N.<\/strong><\/p>\n

You have the right to (i) access your personal data that we have and the details of their treatment; (ii) rectify your personal data if it is inaccurate or incomplete; (iii) cancel your personal data when you consider that they are not required for any of the purposes indicated in the Notice, are being used for non-consensual purposes or the contractual or service relationship has ended; or (iv) oppose the processing of your personal data for specific purposes (hereinafter jointly, the \"ARCO Rights\").<\/p>\n

The mechanisms that have been implemented for the exercise of ARCO Rights are through the presentation of the respective request (i) at the Company's Domicile; or (ii) through the Company Mail, in accordance with the following:<\/p>\n

Within a maximum period of 20 (twenty) business days we will respond to your request and inform you free of charge about the origin of the same, in the terms of article 35 of the Law, through a notification to the owner of the personal data to your (i) domicile; or (ii) email. If your request is appropriate, it must be made effective within a maximum period of 15 (fifteen) business days from the date on which the response to it is communicated.<\/li>\n<\/ol>\n

    I. REVOCACI\u00d3N DE CONSENTIMIENTO PARA EL TRATAMIENTO DE SUS DATOS PERSONALES.<\/strong><\/p>\n

    At any time, you may revoke the consent you have given the Company for the processing of your personal data, so that we stop using them.<\/p>\n

    Your request must be submitted (i) at the Company address; or (ii) through the Company Mail.<\/p>\n

    Likewise, your request must be accompanied by the following information: (i) the full name and address of the owner of the personal data, your email or other means to communicate the response to your request; (ii) the documents that prove the identity or, where appropriate, the legal representation of the owner; (iii) the clear and precise description of the personal data with respect to which it is sought to revoke the consent that has been granted to the Company for the treatment thereof; and (iv) [insert any other element or document that facilitates the location of personal data].<\/p>\n

    Within a maximum period of 20 (twenty) business days we will respond to your request and inform you free of charge about the origin of the same, in the terms of article 35 of the Law, through a notification to the owner of the personal data to your (i) domicile; or (ii) email. If your request is appropriate, it must be made effective within a maximum period of 15 (fifteen) business days from the date on which the response to it is communicated.<\/p>\n

    J. MODIFICACIONES AL AVISO.<\/strong><\/p>\n

    We reserve the right to make modifications or updates to the Notice at any time, in order to attend to legislative reforms, jurisprudential developments, internal policies or new requirements for the provision or offering of our services or products and market practices.<\/p>\n

    These modifications will be available to the public through the following means: (i) visible advertisements in our establishments or customer service centers; (ii) brochures or brochures available in our establishments or customer service centers; (iii) on our website, in the Privacy Notice section; or (iv) we will send them to you at the last email you have provided.<\/p>\n

    K. LEGISLACI\u00d3N APLICABLE, JURISDICCI\u00d3N Y COMPETENCIA.<\/strong><\/p>\n

    The Notice is governed by the Law, Regulations and other applicable legal provisions in force in the United Mexican States. Acceptance of the Notice implies its express submission to the competent courts in the City of Monterrey, State of Nuevo Le\u00f3n, Mexico, for any controversy or claim arising from the Notice.<\/p>\n

    L. CONSENTIMIENTO DEL TRATAMIENTO DE SUS DATOS PERSONALES.<\/strong><\/p>\n

    In accordance with the provisions of article 8 of the Law, the Company is aware that you have given your tacit consent to the processing of your personal data as a result of the Company making the Notice available to you. The foregoing, unless you notify otherwise to the Person in Charge of the Company's Personal Data Department at the (i) Domicile of the Company; (ii) Company Mail; or (iii) Company telephone number.<\/p>\n
