NOTICE OF PRIVACY MR.PRESTA, S.A. DE C.V., S.O.F.O.M., E.N.R.
En virtud de lo dispuesto por la Ley Federal de Protección de Datos Personales en Posesión de Particulares (LFPDPPP), su Reglamento, los Lineamientos del Aviso de Privacidad y las demás Disposiciones aplicables (en adelante denominados conjuntamente como la “Ley”), se emite el presente Aviso de Privacidad (en lo sucesivo el “Aviso”) en los siguientes términos y condiciones:
A. RESPONSIBLE FOR THE PROTECTION OF YOUR PERSONAL DATA.
Presta, S.A. DE C.V., S.O.F.O.M., E.N.R., cuyo nombre comercial es MR Presta (en lo sucesivo la “Sociedad”) es responsable del tratamiento de sus datos personales, la cual tiene su domicilio en Torres IOS Campestre, Ave. Ricardo Margain 575, Parque Corporativo Santa Engracia, San Pedro Garza García, Nuevo León, México (en lo sucesivo el “Domicilio de la Sociedad”), su correo electrónico es soporte@mrpresta.com(hereinafter the "Company Mail") and its telephone number is +52 (81) 8000 7946 (hereinafter the "Company Telephone"). In addition, the data of the person in charge (hereinafter the "Person in Charge") of the Department of Personal Data of the Company are the following: (i) Carlos Rosso; and (ii) the Person in Charge can be reached at the Company's Domicile, at the Company's Mail and on the Company's Telephone.
B. DATOS PERSONALES RECABADOS Y SOMETIDOS A TRATAMIENTO.
Conforme a lo anterior, le informamos que MR. PRESTA obtendrá sus datos personales, ya sea de forma directa o indirecta, cuando realiza una solicitud y proporciona sus datos personales para efectos de la prestación de los servicios de crédito que ofrece MR. PRESTA, a través de nuestra página de Internet, la (“Página”) y a través de un tercero (socio comercial) o cualquier otro medio personal o electrónico.
MR. PRESTA sujeta a tratamiento sus siguientes Datos Personales obtenidos a través de los medios antes descritos:
a)Datos de identicación y contacto
b)Datos migratorios
c)Datos Patrimoniales y/o financieros
Adicionalmente se da tratamiento a los siguientes Datos Sensibles:
a) Datos biométricos.1
Estos datos podrán ser utilizados, entre otros fines, para evaluar los riesgos inherentes al crédito que solicite, verificar su identidad, evaluar y calificar su capacidad crediticia y;
se hace de su conocimiento que MR. PRESTA trabaja con socios comerciales, por lo que cualquier dato que usted proporcione a cualquier de estos, séra bajo el propio Aviso de Privacidad de cada uno de nuestos socios comerciales, por lo que MR. PRESTA solo tendrá la responsabilidad de protección de los datos personales sobre los datos propionados directamente, por lo tanto, usted como Titular de los datos, será
el único responsable de la información y datos personales que comparta y el tratamiento que se les dé bajo dichos supuestos.
C. FINALIDAD CON QUE SE RECABARÁN Y UTILIZARÁN SUS DATOS PERSONALES.
Your personal data will be collected and used for the following purposes:
a. Certificar la personalidad de las personas o sociedades que soliciten a la Sociedad un crédito.
b. Verificar el historial crediticio de las personas que soliciten un crédito.
c. Integración del expediente de información de nuestro cliente.
d. Gestión, control, administración y procesamiento de la solicitud de crédito y, en su caso, el otorgamiento de este.
e. Gestión, control, administración, ejecución y cumplimiento del contrato de crédito celebrado con el cliente conforme a la solicitud correspondiente.
f. Gestión, control y administración de la cobranza administrativa (a través de cualquier medio de contacto otorgado en la solicitud), extrajudicial y, en su caso, judicial derivada de los servicios proporcionados por MR. PRESTA.
g. Investigación de cambios en el perfil transaccional del cliente.
h. Cumplimiento a obligaciones de carácter fiscal o comercial.
i. Atención de consultas, dudas, aclaraciones o quejas del cliente.
j. Estadística y registro histórico de usuarios y clientes.
k. Creación, mantenimiento y entrenamiento de los modelos de riesgo predictivos de MR. PRESTA.
l. Mantener la seguridad de la información y de la operación.
m. Protección ante casos de robo de identidad.
D. DATOS PERSONALES QUE OBTENEMOS DE USTED Y A TRAVÉS DE QUE MEDIO LOS OBTENEMOS.
For the purposes indicated in the Notice, we may collect your personal data in different ways, when (i) you provide them directly to us; (ii) you visit our website or use our online services; (iii) we obtain information through other sources that are permitted by Law; and (iv) we collect and obtain information through the approval and authorization of the Client to third parties who own databases to provide their information or contact details.
E. USO DE COOKIES, WEB BEACONS Y OTRAS TECNOLOGÍAS.
We inform you that on our website, www.mrpresta.com, nos reservamos el derecho de utilizar herramientas electrónicas como cookies y web beacons para obtener información de usted considerada como datos personales, incluyendo de manera enunciativa más no limitativa, (i) su tipo de navegador y sistema operativo; (ii) las páginas de Internet que visita; (iii) los vínculos que sigue; (iv) su dirección IP; y (v) la página de Internet que visitó antes de entrar a la nuestra. F. POLÍTICAS DE SEGURIDAD.
PRESTA protege sus datos personales usando el estándar de la industria en materia de encriptación, de esta forma garantizamos que los datos que se envían desde la página de Internet lleguen seguros a nuestros servidores. Almacenamos y procesamos tu información manteniendo siempre medidas de seguridad orientadas a proteger tus datos personales.
En MR. PRESTA contamos con procedimientos que dictan quién y bajo qué condiciones se puede tener acceso a los datos, dando siempre la máxima prioridad a la protección de su privacidad. Asimismo, asumimos medidas de seguridad físicas para prevenir el acceso no autorizado a nuestros sistemas e instalaciones.
G. LIMITACIÓN DEL USO DE SUS DATOS PERSONALES.
You can stop receiving information of any nature from the Company through emails or telephone calls by giving a notification to the Manager of the Company's Personal Data Department at the (i) Company address; or (ii) Company Mail; or (iii) Company telephone number.

The Company in this act expresses its consent and indicates that all information and data about you that are known to the Company will be solely and exclusively for purposes derived from the Contract, for which the Company acknowledges that no data or information of yours will be sold to third parties or parties that are not specifically linked to the relationship that exists between the Company and the Client, except in the event that such information is required by a governmental or regulatory authority.
H. EJERCICIO DE SUS DERECHOS DE ACCESO, RECTIFICACIÓN, CANCELACIÓN Y OPOSICIÓN.
You have the right to (i) access your personal data that we have and the details of their treatment; (ii) rectify your personal data if it is inaccurate or incomplete; (iii) cancel your personal data when you consider that they are not required for any of the purposes indicated in the Notice, are being used for non-consensual purposes or the contractual or service relationship has ended; or (iv) oppose the processing of your personal data for specific purposes (hereinafter jointly, the "ARCO Rights").
The mechanisms that have been implemented for the exercise of ARCO Rights are through the presentation of the respective request (i) at the Company's Domicile; or (ii) through the Company Mail, in accordance with the following:

- Within a maximum period of 20 (twenty) business days we will respond to your request and inform you free of charge about the origin of the same, in the terms of article 35 of the Law, through a notification to the owner of the personal data to your (i) domicile; or (ii) email. If your request is appropriate, it must be made effective within a maximum period of 15 (fifteen) business days from the date on which the response to it is communicated.

I. REVOCACIÓN DE CONSENTIMIENTO PARA EL TRATAMIENTO DE SUS DATOS PERSONALES.
At any time, you may revoke the consent you have given the Company for the processing of your personal data, so that we stop using them.
Your request must be submitted (i) at the Company address; or (ii) through the Company Mail.
Likewise, your request must be accompanied by the following information: (i) the full name and address of the owner of the personal data, your email or other means to communicate the response to your request; (ii) the documents that prove the identity or, where appropriate, the legal representation of the owner; (iii) the clear and precise description of the personal data with respect to which it is sought to revoke the consent that has been granted to the Company for the treatment thereof; and (iv) [insert any other element or document that facilitates the location of personal data].
Within a maximum period of 20 (twenty) business days we will respond to your request and inform you free of charge about the origin of the same, in the terms of article 35 of the Law, through a notification to the owner of the personal data to your (i) domicile; or (ii) email. If your request is appropriate, it must be made effective within a maximum period of 15 (fifteen) business days from the date on which the response to it is communicated.

J. MODIFICACIONES AL AVISO.
We reserve the right to make modifications or updates to the Notice at any time, in order to attend to legislative reforms, jurisprudential developments, internal policies or new requirements for the provision or offering of our services or products and market practices.
These modifications will be available to the public through the following means: (i) visible advertisements in our establishments or customer service centers; (ii) brochures or brochures available in our establishments or customer service centers; (iii) on our website, in the Privacy Notice section; or (iv) we will send them to you at the last email you have provided.
K. LEGISLACIÓN APLICABLE, JURISDICCIÓN Y COMPETENCIA.
The Notice is governed by the Law, Regulations and other applicable legal provisions in force in the United Mexican States. Acceptance of the Notice implies its express submission to the competent courts in the City of Monterrey, State of Nuevo León, Mexico, for any controversy or claim arising from the Notice.
L. CONSENTIMIENTO DEL TRATAMIENTO DE SUS DATOS PERSONALES.
In accordance with the provisions of article 8 of the Law, the Company is aware that you have given your tacit consent to the processing of your personal data as a result of the Company making the Notice available to you. The foregoing, unless you notify otherwise to the Person in Charge of the Company's Personal Data Department at the (i) Domicile of the Company; (ii) Company Mail; or (iii) Company telephone number.
